Terms of Use

These Terms of Use (“Terms”) are a binding agreement between you and All Things Labs (“we,” “us,” or “our”) governing your use of the Daybreak mobile application and related services (the “App”). Please read them carefully.

1. Acceptance and eligibility

By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App. You must be at least 13 years old (or 16 in the European Economic Area, where required) to use Daybreak.

2. The service

Daybreak is an alarm and wake-up app that provides features such as sunrise-style alarms, wake-up challenges, a nightstand clock, mood check-ins, and wake-up insights. We may add, change, or remove features over time.

3. Your account

Some features require an account. You agree to provide accurate information, to keep your login credentials confidential, and to be responsible for all activity under your account. Notify us promptly at support@allthingslabs.com if you suspect unauthorized use.

4. Subscriptions and purchases

Daybreak may offer paid subscriptions and in-app purchases. These are sold and billed through the Apple App Store or Google Play under their terms, not directly by us. Where subscriptions are offered:

  • Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period.
  • You manage and cancel subscriptions in your Apple or Google account settings, not within Daybreak.
  • Any free trial converts to a paid subscription unless cancelled before it ends.
  • Refunds are handled by Apple or Google according to their policies.

5. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the App’s source code, except where permitted by law.
  • Interfere with, disrupt, or overload the App or our servers.
  • Access the App through unauthorized means or use it for unlawful purposes.
  • Resell, sublicense, or commercially exploit the App without our permission.

6. Alarms are not guaranteed — important

Daybreak relies on your device and its operating system to deliver alarms, and we cannot guarantee that any alarm will sound or that it will sound at the exact time set. Alarm delivery can be affected by factors outside our control, including device power and battery-optimization settings, silent/vibrate or volume settings, Focus / Do Not Disturb modes, notification permissions, the App being force-closed, software updates, and device or OS bugs.

Do not rely on Daybreak for any wake-up or timing that is critical to your safety, health, employment, travel, or property. Use a redundant alarm for important events. You assume all risk arising from missed, late, or failed alarms to the fullest extent permitted by law.

7. Intellectual property

The App, including its software, design, content, and trademarks, is owned by All Things Labs and protected by law. We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, subject to these Terms.

8. Your content

You retain ownership of the content you create in the App (such as alarms, settings, and mood entries). You grant us a limited license to store, process, and sync that content solely to operate and provide the App to you, as described in our Privacy Policy.

9. Third-party services

The App depends on third-party platforms and services, including Apple and Google for distribution, sign-in, and billing. Your use of those services is governed by their respective terms, and we are not responsible for them.

10. Disclaimer of warranties

The App is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that alarms will always function.

11. Limitation of liability

To the fullest extent permitted by law, All Things Labs will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from missed or failed alarms, loss of data, or loss of profits. Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim, or US $50.

12. Indemnification

You agree to indemnify and hold harmless All Things Labs from any claims, damages, or expenses arising out of your misuse of the App or violation of these Terms.

13. Termination

We may suspend or terminate your access to the App if you violate these Terms or misuse the service. You may stop using the App and delete your account at any time.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the App after changes take effect constitutes acceptance of the updated Terms.

15. Governing law

These Terms are governed by the laws of the State of Arkansas and the United States, without regard to conflict-of-laws principles. You agree that the state and federal courts located in Arkansas will have exclusive jurisdiction over any dispute, to the extent permitted by law.
